1. The seller

The World of Freddie online shop is operated by TH ASSET MANAGEMENT, a.s., with its registered office at Nadjezdová 695/28, 783 13 Štěpánov, Czech Republic, Company ID 19172656, VAT number CZ19172656, registered in the Commercial Register kept by the Regional Court in Ostrava, Section B, Insert 11535 (“we”, “the seller”). World of Freddie is the name of the project and of the shop; the other party to every contract concluded in the shop is TH ASSET MANAGEMENT, a.s.

2. Scope

These terms govern the purchase of goods and services in the shop by consumers, meaning individuals who are not acting in the course of their business or profession. They form part of every contract concluded through the shop. Where we agree something different with you in the contract itself, that agreement takes precedence over these terms.

3. How the contract is concluded

The products and prices presented in the shop are information about our offer, not a binding offer. You place an order by adding products to the cart, entering your details at checkout, choosing a delivery and a payment method and confirming the order with the order button. Before you confirm, you can check and correct everything you have entered.

The contract is concluded when we confirm acceptance of your order by e-mail. The concluded contract is stored electronically in our shop system and is not accessible to third parties. You can save or print these terms at any time from this page.

Experiences are booked for a specific date. You request a date through the experience page and we confirm it by e-mail; the contract for an experience is concluded when we confirm the date, and nothing is charged before the date is agreed. More on the Experiences page.

Any costs of the means of distance communication you use to place the order (internet connection, phone) are borne by you at the rates of your own provider.

4. Language of the contract

The contract is concluded in the language of the shop version in which you place the order: English, Czech, German, Spanish, French, Hungarian or Italian.

5. Prices

All prices include VAT. Delivery costs depend on the destination and the delivery method and are shown at checkout before you confirm the order. The total at checkout is the price you pay. The price shown at the time you place the order applies.

6. Payment

You can pay with the payment methods offered at checkout; an overview is on the Shipping & payment page. Payments are processed through Shopify’s secure payment gateway. Your card details are handled by the payment provider and never reach us.

Goods are paid for when you place the order. An experience is paid for once its date has been confirmed.

7. Delivery

We deliver to the countries that can be selected at checkout, using the carriers and delivery methods offered there for your address. Orders are dispatched within 2 working days, and you receive a tracking link by e-mail as soon as the parcel is handed over. Delivery times and free delivery are described in the Shipping policy.

If a parcel arrives damaged, photograph it and write to info@worldoffreddie.com with your order number.

8. Ownership and risk

You become the owner of the goods when you take delivery of them, provided they have been paid in full. The risk of damage to the goods passes to you when you, or a person you have designated, take delivery of them.

9. Right of withdrawal

You may withdraw from a contract for the purchase of goods within 14 days, without giving a reason. The period starts on the day you take delivery of the goods; if an order is delivered in several parts, on the day you take delivery of the last part.

To withdraw, tell us within that period. An e-mail to info@worldoffreddie.com is enough, or you can use the model withdrawal form (PDF). It is sufficient to send the notice before the period expires.

Send the goods back to us no later than 14 days after withdrawing. The cost of sending the goods back is paid by you. We refund the purchase price together with the cost of the original delivery (up to the cheapest standard delivery we offer) within 14 days of your withdrawal, using the same payment method you paid with. We send the refund once we have received the goods back, or once you show us they have been dispatched, whichever happens first. You are liable for any diminished value of the goods resulting from handling them beyond what is necessary to establish their nature, characteristics and functioning.

The right of withdrawal does not apply to:

• goods made to your specification;
• food that has been opened;
• experiences: a leisure service provided on a specific date is excluded from the right of withdrawal under § 1837(j) of the Czech Civil Code. Experiences have their own cancellation terms; write to info@worldoffreddie.com.

Gift cards. You may withdraw from the purchase of a gift card within 14 days of receiving it, as long as it has not been used, in whole or in part.

10. Defects and complaints

We are responsible for the goods being free of defects when you take delivery of them. Goods are covered by a two-year warranty: you may claim a defect that appears within two years of taking delivery. Write to info@worldoffreddie.com with your order number and a description of the defect. We will confirm that we have received the complaint and handle it within 30 days, unless we agree with you on a longer period. The procedure is described on the Returns & complaints page.

11. Out-of-court dispute resolution

If we cannot resolve a dispute between us, you may turn to the Czech Trade Inspection Authority (Česká obchodní inspekce), the body competent for out-of-court resolution of consumer disputes: www.coi.cz, proposals at adr.coi.cz. The Czech Trade Inspection Authority also supervises compliance with consumer protection law.

12. Personal data

We process your personal data in accordance with our Privacy policy.

13. Governing law

Contracts concluded in the shop are governed by Czech law, in particular Act No. 89/2012 Coll., the Civil Code, and Act No. 634/1992 Coll., on Consumer Protection. If you live in another country, this choice of law does not deprive you of the protection afforded to you by the mandatory provisions of the law of the country of your habitual residence (Article 6 of Regulation (EC) No 593/2008, Rome I).

14. Final provisions

We may amend these terms. Your contract is governed by the version published in the shop at the time you place your order.
